LAST UPDATE: 6/15/2026This contract applies to the artist further called Seller and person or institution further called Customer purchasing from Seller a work of art further called Product. By ordering Product from the Seller, the Customer agrees to the following terms and conditions.PAYMENTS1. Customer agrees to pay the due amount upfront for any orders of value lower than or equal to $60.2. On orders above $100, Customer agrees to pay half of the invoice total upfront. The remaining balance must be paid upon approval of the initial sketch.3. Any other payment schedule must be mutually agreed upon before work on the Product commences.4. Customer accepts that work on the Product will not commence until payment has been received by Seller according to the agreed schedule.5. Certain types of work do not allow for split payments. In such cases, Customer will be informed and asked to agree to a different payment schedule before work can commence.PRODUCT DELIVERY6. Customer agrees that Product will be delivered digitally to the email address provided by Customer after the final payment has been received by Seller.7. Any other method of delivery, either digital or physical, must be mutually agreed upon before work commences. Customer is responsible for any costs incurred by alternative delivery methods, including postal fees, material costs, subscription fees, and similar expenses.8. It is the sole responsibility of Customer to provide a delivery method that works for both parties. Seller cannot be held responsible for loss of access to the delivery method, lost files, spam filtering, or other technical issues outside Seller's control.9. Upon delivery of the Product, it is the Customer's responsibility to store it properly. Loss of Product due to negligence will not be reimbursed by Seller. Seller cannot guarantee that backup copies will remain available if Customer loses their files.REVISIONS10. Customer has the right to 5 complete revisions during the sketch phase.11. Customer has the right to request a reasonable amount of minor edits after completion, such as changing an eye color or correcting a small detail, up to an additional 10% of the total time spent creating the originally delivered Product. Requests beyond this limit may require additional fees and mutual agreement before work begins.CURRENCY & PAYMENT CONVERSIONS12. International Customers agree to pay the total amount specified in USD unless otherwise agreed upon by the Seller.13. Customers residing in the Philippines may pay in Philippine Pesos (PHP). The PHP amount will be calculated using the Seller's current conversion rate at the time the invoice is issued.14. It is the sole responsibility of Customer to bear any currency conversion costs, bank transfer fees, payment provider service fees, and any other costs involved in transferring funds to the Seller.15. Payment is considered received and completed only when the total amount received by Seller is equal to the invoiced amount after any applicable fees or deductions.REFUND POLICY16. Customer has the right to request a full refund if there has been no progress for two consecutive months, or when Product has not been completed within four months. Refund conditions for commissions requiring more extensive work must be agreed upon separately before work commences. These provisions exclude interruptions caused by illness, accidents, emergencies, or other reasonable circumstances beyond Seller's control.17. Customer agrees to communicate in a timely manner regarding feedback, approvals, clarifications, and other requests necessary for completion of the Product.CLIENT COMMUNICATION & INACTIVITY18. If Customer becomes unresponsive for more than 7 consecutive days after Seller has requested feedback, approval, references, or other information necessary to continue the commission, Seller reserves the right to continue work using their best judgment based on previously approved materials and instructions.19. Extended periods of inactivity, ghosting, or failure to respond may result in delays to the commission timeline. Seller shall not be held responsible for delays caused by Customer's lack of communication.20. If Customer remains unresponsive for an extended period, Seller reserves the right to mark the commission as completed using the latest approved stage of work. Refunds will not be issued for completed work affected by Customer inactivity.PERSONAL AND COMMERCIAL USE21. The Product received by Customer is for personal use only. Any commercial use, reproduction, redistribution, publishing, merchandising, resale, or profit-generating use must be approved beforehand by Seller and may require the purchase of a commercial license.22. Customer does not hold the right to use the Product in any blockchain-related technology, including NFTs, cryptocurrency projects, or future technologies of a similar nature.23. Customer does not hold the right to use the Product for AI datasets, AI training, AI generation tools, machine learning systems, or any future technologies of a similar nature without explicit written permission from Seller.PROFESSIONAL BOUNDARIES24. Purchasing a commission does not establish a personal friendship, private relationship, partnership, mentorship, or special access to Seller.25. Seller reserves the right to maintain professional boundaries at all times. Customers are expected to respect Seller's privacy, personal time, and personal relationships.26. Any attempts to foster unhealthy parasocial relationships, emotional dependency, harassment, stalking, excessive personal demands, boundary violations, or similar inappropriate behavior may result in cancellation of the commission and refusal of future services.CANCELLATIONS & DISPUTES27. Seller reserves the right to refuse or cancel any order, under the condition of a full refund when applicable, without providing a reason to Customer.28. Any disrespectful, abusive, discriminatory, threatening, manipulative, or otherwise inappropriate behavior will not be tolerated and may result in cancellation of the order. Customer will receive a full or partial refund depending on the amount of work completed. Seller reserves the right to refuse future services to the Customer.29. Customers are expected to contact Seller regarding any payment issues, concerns, or disputes before initiating a chargeback, payment reversal, or formal payment dispute.30. Chargebacks or payment disputes filed without first attempting to communicate with Seller may result in immediate blacklisting, permanent refusal of future services, and forfeiture of eligibility for future commissions where permitted by applicable law.
